Land Tract #1: (788 acres +/-) (W/2 NE) (Lots 3 & 4) (E/2 SW) (W/2 SE) (SE SE) of Section 30, and (N/2) (N/2 S/2) of Section 31-T32S-R12W, and (SE SE) of Section 25, and (NE/4) (NE SE) of Section 36-T32S-R13W; All lying South and East of the Gyp Hill Road in Barber County, Kansas

Land Tract #2:  (413 acres +/-) (S/2 SE) (SE SW) of Section 36-T32S-R13W, and (Lots 1 & 2), (S/2 NE) (N/2 SE) (SW SE), (Lots 3 & 4) (S/2 NW) of Section 1-T33S-R13W; All lying South and East of the Gyp Hill Road in Barber County, Kansas.

Mineral Tracts #3 - #7: Each mineral tract is offered with all of the Seller’s mineral interest with the exception of the Seller’s Reservation on mineral tract #4. All tracts are lying South and East of the Gyp Hill Road and located West of the 6th Principal Meridian in Barber County Kansas.

Tract #3: Minerals in (W/2 NE) (Lots 3 & 4) (E/2 SW) (W/2 SE) (SE SE) se of Gyp Hill rd. Section 30-T32S-R12W

Tract #4: Minerals in (N/2) (N/2 S/2) se of Gyp Hill rd. Section 31-T32S-R12W less and except and reserving unto the Seller as follows; Seller reserves royalty income payments from existing production in reference to the “Lonker - 31” well.

Order of Sale: tracts as numbered. Land will be offered separately from the minerals

Taxes: Barber County Tax records show 2009 taxes were $2231.80

Possession of Land: Given at Closing, upon payment in full of the purchase price and transfer of title.

Terms: Buyers are required to sign purchase agreement and place 10% of purchase price (cash, or approved checks) in escrow immediately following the auction; the balance of purchase price due at Closing. Buyers unknown to the auction company are required to pre-register prior to auction with bank letter of credit or provide certified funds on sale date.
Title: Sellers will provide to Buyer a title insurance commitment for owner’s policy of title insurance on the surface tract(s) of Land. Buyer shall have Ten (10) days from the date the Commitment is delivered to Buyer to review the Commitment. Land will be conveyed by Warranty Deed.
Minerals will be conveyed by Mineral Deed without Warranty. Seller will not furnish abstracts or title evidence on minerals. Mineral Buyers are responsible for doing their own research and due diligence on minerals prior to auction. Buyers shall have Ten (10) days after sale date to examine title prior to Closing. Information is taken from sources believed reliable; however, no guarantee is made by the auction company. Any announcements made sale day take precedence.
